Terms of Service & User Agreement

1. Acceptance of Terms
By downloading, accessing, or using the JellyPal mobile application (the "Service"), you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Medical Disclaimer (CRITICAL - PLEASE READ)
The Service is Not a Medical Device and Does Not Provide Medical Advice
Informational Use Only
The Service is designed to help you organize and track your medication history. It is not intended to diagnose, cure, treat, or prevent any disease.
No Doctor-Patient Relationship
Use of the Service does not create a physician-patient relationship between you and Inverse Collective LLC.
Titration and Dosage
Any titration schedules, dosage reminders, or "next dose" calculators provided by the App are estimates based on general manufacturer guidelines or your own input. You are solely responsible for verifying your dosage with your prescribing physician. Do not change your medication dose or frequency based on information from the App.
Emergency
If you experience severe side effects (e.g., severe abdominal pain, vision changes, or signs of an allergic reaction), stop using the App and contact your doctor or emergency services (911) immediately.
3. Use of the Service
Eligibility
You must be at least 18 years old to use the Service.
User Responsibility
You are responsible for the accuracy of the data you enter (e.g., dosage amounts). We are not responsible for errors in tracking caused by incorrect user input.
Prohibited Conduct
You agree not to:
- Use the Service to track the illicit use of controlled substances
- Reverse engineer or attempt to extract the source code of the App
- Use the Service to harass or harm another individual
- Violate any applicable laws or regulations
4. Intellectual Property
Our Rights
We own the App, including its visual interfaces, code, and "look and feel."
Your Data
You retain ownership of your health data. You grant us a limited, non-exclusive license to process your data solely for the purpose of providing the Service to you.
5. Subscriptions and Billing
Apple Subscription
The Service may offer "Premium" features via Apple In-App Purchase.
Billing
All billing and refunds are handled directly by Apple. We do not have the ability to process refunds or manage your billing details.
Cancellation
You may cancel your subscription at any time via your Apple ID settings.
6. Disclaimer of Warranties
The Service is Provided "As Is"
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, RELIABILITY, AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT GUARANTEE THAT THE APP WILL BE ERROR-FREE OR THAT YOUR DATA WILL NOT BE LOST.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, INVERSE COLLECTIVE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.
Cap on Damages
IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID TO US, IF ANY, IN THE PAST TWELVE MONTHS OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.
Medical Injury
WE EXPLICITLY DISCLAIM LIABILITY FOR ANY MEDICAL INJURY OR ADVERSE HEALTH OUTCOME RESULTING FROM YOUR USE OF THE APP OR YOUR RELIANCE ON ITS DATA.
8. Indemnification
You agree to indemnify and hold harmless Inverse Collective LLC from any claims, damages, liabilities, and expenses arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
9. Dispute Resolution and Arbitration
Binding Arbitration
Any dispute arising under these Terms will be resolved through binding arbitration in Austin, Texas.
Class Action Waiver
YOU WAIVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
Opt-Out
You may opt out of this arbitration agreement within 30 days of first accepting these Terms by sending a written notice to support@jellypal.app.
10. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes via an in-app notification. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
